1. Terms of Service Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. list what is included in the trip price on our websites and affiliate websites. Please be advised that airfare, gratuity, travel insurance and alcohol are not included. 2. Reservation To reserve your spot on this trip, please complete the Registration form, read the Participation Policy, agree to the policy terms, and make a non-refundable $1000 deposit for your trip. 3. Payment We will send you a link to make payment once we receive your Registration and Participation Policy agreement. A $1000 non-refundable deposit will hold your space for the trip. NOTE: Your booking is not confirmed until your deposit is paid. Final balance is due no later than 90 days before the departure date of the trip. If final payment is not received by 90 days prior to departure, Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. reserve the right to cancel your reservation and accept new reservations for your space. In this case, your deposit will be forfeited. If you do not think you can pay in time please contact us via email. For bookings made less than 90 days prior to departure, the entire trip cost must be paid at time of booking. 4. Cancellation Policy To cancel your booking, you must notify Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. in writing via email to: melody@melodymassey.com. Once we receive your notice, cancellation fees take effect subject to the following terms, based on the date we receive your written notification: • More than 90 days prior to departure: $1000 deposit forfeited • Between 60-90 days prior to departure: 50% of trip cost forfeited • Less than 60 days prior to departure: 100% of trip cost forfeited • Any amount forfeited, which has not already been paid by you to Lindsay Gonzalez, Melody Massey and AGM Travel Ltd., will be recovered from you by Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. as a debt due and payable. • Your trip is transferable should you provide an alternate Participant at the same fare. 5. Changes/Trip Cancellations Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. reserve the right to cancel or modify the trip without prior notice for the safety and/or comfort of Participants as deemed necessary by us, or our travel partners and affiliated entities. In the rare case of a cancellation, we will offer a transfer to another trip or a full refund of your payment received. This constitutes full settlement of claims you may have due to our cancellation. Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. are not responsible for any expenses or damages incurred as a result of trip cancellation including preparation costs, airline tickets, travel documents or other expenses. Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. reserve the right to cancel any trip prior to departure in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. You will not be entitled to claim any additional amounts or seek compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and immunization charges, gear purchases, airfare, airport and airline taxes). 6. Force Majeure Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. will not be deemed in breach of this agreement by reason of delay in performance or nonperformance of any of our obligations under this agreement to the extent that such delay or nonperformance is due to any Force Majeure – circumstances beyond the reasonable control of Lindsay Gonzalez, Melody Massey. and AGM Travel Ltd. 7. Travel Medical Insurance & Travel Insurance (Trip Cancellation & Interruption Coverage) Travel Medical Insurance with Emergency Evacuation coverage is mandatory. Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. require each Participant to purchase individual travel medical insurance for this trip, and submit proof of coverage prior to departure. We also highly recommend that you purchase a travel insurance policy with trip cancellation and interruption coverage. For added protection, we suggest that you add “cancel for any reason” to your policy so no matter what arises you will be covered. Travel Documents and Immunizations It is the responsibility of each Participant to ensure your travel documents meet the following criteria: For all foreign visitors to Indonesia - a passport valid at least six months beyond your arrival date with a minimum of two blank pages. You must also have a return ticket or onward ticket to another country. U.S. citizens, and citizens of 168 other countries, can receive a no-fee Tourist Visa Exemption stamp upon arrival for stays of 30 days or less. Travelers from other countries: Please check your country’s state department website for visa requirements or visit: http://www.imigrasi.go.id/ It is also your responsibility to obtain necessary immunizations as recommended by your doctor or local international travel clinic. 9. Acknowledgment of Risks/Assumption of Responsibility I, Participant, acknowledge that I have voluntarily registered to participate in this trip, which will involve yoga classes, small ship cruising, and water- and land-based adventure activities. These same activities that contribute to the unique character of the trip can cause loss or damage to the Participant including accidental injury, illness, or in extreme cases, permanent trauma, disability or death, and also can cause damage to or loss of property. Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. trips can involve travel to remote places, often many hours from medical facilities. Transportation, evacuations and medical care can be significantly delayed; communication can be delayed, limited or not available. Environmental risks and hazards, and unpredictable forces of nature, including weather, may change to extreme conditions without warning. In consideration of, and the payment for, the right to participate in this trip and for the services arranged for me by Lindsay Gonzalez, Melody Massey and AGM Travel Ltd., I agree to be responsible for my own safety. I, Participant, acknowledge and understand that Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. trips include risks of injury or death. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified herein and those inherent risks not specifically identified. I acknowledge that participation in this activity is purely voluntary, no one is forcing participation, and participation is elected with full knowledge of the inherent risks. I, Participant, assume and accept full responsibility for any injury, death, and loss of personal property, and expenses suffered as a result of those inherent risks and dangers identified above, and those inherent risks and dangers not specifically identified, or as a result of my negligence in participating in this trip. I agree to release Lindsay Gonzalez, Melody Massey, AGM Travel Ltd., their travel partners, and affiliated entities, from any liability, which may hereafter arise out of, or in connection with, my participation in the activities arranged for me by Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. 10. Release and Waiver of Liability ACKNOWLEDGMENT OF RISK AGREEMENT I hereby agree to the following terms and conditions: I am participating in yoga classes and adventure activities during which I will receive information and instruction about yoga, health and wellness. I recognize that yoga and other trip activities require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to, and regarding, my participation in yoga classes and other trip activities. In consideration of being permitted to participate in this trip, I knowingly, voluntarily, and expressly waive any claim I may have against Lindsay Gonzalez, Melody Massey, AGM Travel Ltd., their travel partners, and affiliated entities, for injuries or damages I may sustain as a result of participating in yoga classes or other activities held by Lindsay Gonzalez, Melody Massey, AGM Travel Ltd. or any of their affiliates. I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above. 11. Declaration of Health By accepting this Participant Agreement, I, Participant, represent that I fully understand that my participation in the yoga program and other activities could be injurious to my health and I voluntarily assume all risks related to such activities. Medical care beyond basic first aid, due to remote regions visited, is often not immediately available. If you have physical, dietary or other conditions that may require special attention, please include details in the registration form above when submitting your booking. 12. Personal Release By agreeing to the terms outlined here and elsewhere on Lindsay Gonzalez and Melody Massey/AGM Travel Ltd. websites and affiliated websites, I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. trip, including but not limited to damages as a result of unexpected occurrences including those from weather, local political situations, wildlife or uncontrollable acts of God, including the risk of death. I release Lindsay Gonzalez, Melody Massey and AGM Travel Ltd., their travel partners and affiliated entities, from liability for personal injury, illness, emotional damage, travel expenses or property damage that may incur as a result of participation on this trip. For the benefit of everyone on the trip, Lindsay Gonzalez, Melody Massey and AGM Travel Ltd. reserve the right to accept or reject any Participant at any time without liability, and in the event they determine, in their sole and exclusive discretion, that a Participant is disruptive to the harmony of the trip, they may without any obligation to pay a refund or any other amount whatsoever, expel such Participant from the trip. Lindsay Gonzalez, Melody Massey and AGM Travel Ltd., their travel partners, and affiliated entities, will carry no responsibility or liability for any Participant who leaves the trip prior to its conclusion or for any activity undertaken by any Participant that is not included in the trip itinerary.
